Spain Declines To Allow Puublication of 2007 CPT Prisons report

The Spanish authorities have declined to allow publication of a Council of Europe inspection of Prison, Police and detention facilities in Spain.

The Celtic League was alerted to the failure to make public the document when the Committee for the Prevention of Torture announced its schedule of visits for 2011 and included Spain within that schedule. We realised the report on the 2007 visit had still to be published.

The European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT) is a highly respected arm of the Council of Europe (CoE) and has done great work in improving the conditions of detention and the treatment of those in custody throughout CoE States.

However its work requires the full cooperation of member States and its reports when completed are `confidential’ unless the State involved approves publication. Most States do not withhold permission for publication – generally approximately eighteen months after the relevant visit.

The reply from the CPT is set out below:

“Dear Mr Moffat,

thanks for your mail.

The visit report on the 2007 visit to Spain has been prepared and transmitted to the Spanish authorities a long time ago. (It was a “periodic visit”; reports for such visits are usually sent approx. 6 months after the visit.)

However, such visit reports are confidential, unless the authorities request publication. So far, the Spanish authorities have not done that, so this report has not been made public.
