Manx CM Retains Nationalist Core Principles

The new Manx Chief Minister has said that he still `believes passionately in the preservation of Manx independence’ and still retains many of the core principles that he had when he was a member of the Nationalist Party Mec Vannin in the 1970s.

He was speaking to independent Manx radio station 3FM following his election (a report and audio clip can be found below):

Offshore Wind Farms – IoM Respond

The International Maritime Organisation has said that it is active in relation to the siting of offshore wind farms in busy sea lanes.

In a response following a query from the Celtic League (see link)

the Maritime Safety Division says that whilst no specific guidance has been developed the Sub-Committee on Safety of Navigation has considered a proposal to establish an `Area to be Avoided’ in respect of a development of the English south coast.

The full text of the IMO response is set out below:

“11 October 2011

Dear Mr. Moffatt,

On behalf of the Secretary-General, I thank you for your letter of 1 October 2011 enquiring if IMO has developed any guidance notes in relation to the siting of offshore wind farms and the hazards to navigation which this might cause.

In this regard, I wish to advise you that as yet, no specific guidance has been developed by IMO in relation to the siting of offshore wind farms. However, there are existing guidelines and criteria for General Provisions on Ships’ Routeing (GPSR) (Resolution A.572(14), as amended). The purpose of ships’ routeing is to improve the safety of navigation in converging areas and in areas where the density of traffic is great or where freedom of movement of shipping is inhibited by restricted sea-room, the existence of obstructions to navigation, limited depths or unfavourable meteorological conditions. The GPSR outlines procedures and functions of IMO including responsibilities of Governments and recommended and compulsory practices.

You may also wish to note that the Sub-Committee on Safety of Navigation in June this year considered a proposal for the establishment of a new Area To Be Avoided to allow the development of adjoining wind farms in the vicinity of the Thornton and Bligh Banks in the English Channel. Subsequently, the Sub-Committee was informed that the original proposal should be revised by changing the proposed establishment of an Area To Be Avoided to a proposed Precautionary Area. This would not hamper the flow of traffic during the construction phase of the wind farms. It was further clarified that a revised proposal may be submitted in 2013 depending on the experience gained and how the construction of the wind farms progressed.

Istanbul Protocol – IoM Response

The Department of Home Affairs has responded to a query from the Celtic League about the application of the United Nations `Istanbul Protocol’ in the Isle of Man.

The League wrote to all British jurisdictions in July following criticisms voiced by the UN Committee Against Torture about the failure of the Irish government to provide specific training on the Protocol to both Police and Prison Officers.

The Isle of Man response (in late August) was the final reply awaited and it is clear from collating the replies that no specific training on the Protocol is provided in N. Ireland, Scotland, England and Wales or the Isle of Man.

The full text of the IOM response is set out below:

“31 August 2011

Dear Mr Moffatt

Re. United Nations Convention Against Torture

Thank you for your letter dated 17 th July 2011.

In the United Kingdom’s 2nd Periodic Report on compliance with the UN Convention Against Torture (CAT) in 1995, which is the earliest report that the Isle of Man contributed to, in relation to Article 10 the Island stated:

“The prohibition against torture is well understood by police, prison officers, medical personnel, public officials and others who may be involved in the custody, interrogation or treatment of an individual subjected to any form of arrest, detention or imprisonment. Such persons are aware of the need to treat everyone with humanity and respect and to act within the law at all times. Such persons may also be subject to internal disciplinary codes, as well as to legal proceedings, if they use any unnecessary violence against any prisoner or other person with whom they may be brought into contact in the execution of their duty.”

In the Isle of Man’s contribution to the UK’s 4th Report we said:

“38. The initial report outlined the general principles – respect for the individual, humanity, and the need to act within, and uphold, the law at all times – under which the Isle of Man Constabulary and the Isle of Man Prison Service operate.”

We also indicated members of the Constabulary and the Prison Service are kept up to date on developments in training in the United Kingdom.

I am satisfied officers of the Isle of Man Constabulary and the Prison Service are aware of their duty to carry out their functions in accordance with the law and the Island’s obligations under this Convention. I have taken this opportunity nevertheless to write to the Chief Constable and the Prison Governor to reiterate the importance of ensuring officers, staff and medical personnel under their leadership, or performing functions under their overall supervision, understand the importance of complying with international obligafJons in the execution of their duties.

In any event, if the Celtic League has specific concerns with regard to the Island’s obligations under the Convention I would be grateful for further information so these concerns may be resolved.

Manx Election – New Chief Minister in Post

A new Chief Minister was elected on the Isle of Man last week (11th October 2011) by members of the House of Keys, following a general election on the Island last month.

Ramsey MHK Allan Bell become the Island’s fifth Chief Minister, following unprecedented scenes at the Tynwald when a competitor to Mr Bell for the Chief Minister position threatened to withdraw from standing, because was no “freedom of speech in the House of Keys” following a heated exchange with the President of Tynwald.

Peter Karran said that he would be withdrawing from standing as Chief Minister, because following a warning given by the President of the Tynwald, Clare Christian to Mr Karran’s proposer, MHK Kate Beecroft. President Christian said that MHK Beecroft was spending more time in her maiden speech criticising MHK Alan Bell than proposing Mr Karren as Chief Minister. President Christian successfully urged MHK Karren to continue to allow his name to be put forward in the interests of democracy and after 45 minutes of speeches the result of the election was 29 votes to MHK Bell and 3 votes to MHK Karren.

(Since the election, in a move which seems to augur well for consensus government, the new Chief Minister has included Mr Karran in his Ministerial team, as Minister for Education.)

The general election was held on the Isle of Man on 29th September 2011 and saw several changes and the status quo was maintained in the majority of constituencies. Interestingly three Liberal Vannin party candidates were successful in the polls, including Kate Beecroft who won a seat in Douglas South and two other party candidates, who were all sworn in alongside their party leader, Peter Karran on 4th October, increasing the party’s presence in the House of Keys from about 4% to 12.5%. Traditionally political party representatives do not usually garner success on the Isle of Man in elections and the majority of candidates stand as independents.

Every five years the House of Keys is dissolved by the Lieutenant Governor and a General Election is held to elect members of the House of Keys. 24 members of the House of Keys are elected and 16 year olds are eligible to vote.

Mann: Governor Stripped of His Powers Still Calls The Shots

Mec Vannin (the Manx Nationalist Party) chose the Tynwald Day edition (earlier this month) of its newspaper Yn Pabyr Seyr to set out its `welcome’ to the Islands new Lieutenant Governor (LG). It also opened the piece with a swipe at another nationalist bête noire the BBC.

Recently the Manx government announced further changes to the LG role which are said to `strip him’ of even more of his `few remaining powers’.

However the Mec Vannin news item, though couched in light-hearted terms, reminds the more gullible in Mann that the Governors presence here is more `hands on’ than the public or Tynwald may think and when the chips are down he will be the one calling the shots for the UK.

“According to the BBC, which continues to thieve nearly £5,000,000 a year out of this country, the Manx people had a say in the appointment of the Lieutenant Governor for the first time this year. Sorry, but that particular election got past us. Actually, a panel of three pillars of Manx society were given a choice of names. Actually, a choice of name. Nice to see a clear and transparent democratic process in operation.

Of course, the latest incumbent is such a nice young man. Well, that makes it all alright then, doesn’t it? The whitewash is far too thin to hide the fact that the Lieutenant Governor remains a colonial appointment sent here to keep an eye on the natives and report back to Westminster if we dare get any ideas above our station. Those who try defend the indefensible claim that the governor’s function is essentially reduced to attending tea parties. That would explain why the Chief Constable went to seek his advice before daring to arrest former Chief Minister Richard Corkill on fraud charges.

And what terrific value for money! The LG is appointed by the UK and we pay all expenses. He gets a well appointed residence in extensive grounds, rarely has to get out of bed before midday unless he’s forced to attend a Coffee MORNING (how tiresome), is driven everywhere by a chauffeur in the latest Jaguar saloon, a day and night chef (in case he feels like a midnight snack), a housekeeper, P.A. , all necessary household staff and a huge furniture budget.

It has been calculated that each cup of coffee he slurps at the various events he graces to allow the little people bow and scrape to him costs the tax-payer upwards of £1,000.

But let’s not forget that he ISN’T there just to open fetes and grace coffee mornings. His full list of powers show that he is very much capable of wielding a lot of power on the UK’s behalf through the back door.”

Arms Traders Profit as Africa Suffers

As frantic appeals are launched to avoid a humanitarian crisis in the horn of Africa it is useful to remind ourselves that the other great curse that Africa faces is arms trading.

A detailed (AEFJN – AFRICA EUROPE FAITH AND JUSTICE NETWORK) report issued six months ago on the global arms trade into that continent is set out in this link:

A quick scan of the document throws up the by now `perennial link’ to the Isle of Man which along with other offshore jurisdictions is a familiar location for companies who aid and abet this trade.

What is disappointing is that these connections stretch back over thirty years.

In 2001 we reported (in the old Celtic News archive – unfortunately not now available on our current site) on arms trading links involving the son of former French President, Francois Mitterand, and other unrelated scandals.

Mitterand was among a number of French celebrities subsequently convicted of crimes eight years later related to $790 million in arms sales to Angolan President Eduardo dos Santos’s MPLA between 1993 and 1998, when it was fighting UNITA rebels in a devastating civil war.

Mitterrand was cleared of the accusation of illegal weapons sales, but an Angolan court found him guilty of taking a total of $2.6 million in covert payments from arms trader Pierre Falcone to pass on key Angolan contacts and protect Falcone’s interests. Falcone was reported to have a web of companies in Britain, Argentina, Canada and the Isle of Man.

In the 2001 Celtic News report which is set out below we referenced a string of other arms trading scandals involving the Isle of Man stretching back to the 1980s. What the recent AEFJN report shows is that sadly nothing has changed and as a community we still prosper from the misery inflicted on others.

“MITTERAND ALLEGATIONS LATEST IN SERIES OF ARMS LINKS

New allegations linking the son of the late French president to arms trading in Africa indicate that Manx registered companies may still be involved in this deplorable trade. This despite assurances that loopholes allowing Arms Traders to operate from the Isle of Man would be plugged.

Once again the links alleging trading by companies operating from the Isle of Man with the arms trade in Africa have been exposed. Jean-Christophe Mitterand son of the late French president is accused of illegal arms trafficking and is said to have used a string of companies in various tax havens including Switzerland and the Isle of Man. This is the latest in a string of connections stretching back decades which have seen Manx based companies involved in arms trading and breaches of UN sanctions on the continent.

Last year a United Kingdom newspaper (1) exposed the use by British companies of offshore centres like the Isle of Man in arming the Rwanda Hutu militia. These militias were involved in several horrendous incidents including an attack on a group of British and American tourists. Eight of the party, including four Britons, were butchered.

This was not the first Rwanda link. In November 1996 documents seized in Rwanda from retreating Hutu militia revealed a tangled web of arms trafficking linked to the Isle of Man and other off-shore centres(2). The ‘Sandline’ episode also showed that arms traders were still using offshore jurisdictions in an effort to conceal their tracks.

What is perhaps disturbing about these Africa links is that they are not isolated incidents but stretch back over decades. There is indeed a culture of shadowy and sinister links which probably began at the time of Apartheid and the Rhodesia sanctions and have continued since.

In 1987 the United Kingdom Independent newspaper (3) revealed details of secret meetings between the Isle of Man government and Southern African business interests.

Also in 1987 first details of an aircraft leasing and transport operation similar to that cited in the recent news reports was revealed. The Observer newspaper (4) carried a report that a company with offices registered in the Isle of Man, Guernsey and Shannon freeport in the Irish Republic was engaged in leasing Hercules transport aircraft to a company called Southern Air Transport, based in Florida, which was at that time engaged in supplying arms to rebels fighting with UNITA against the Angolan government.

After the exposure of the Manx involvement in the Rwanda genocide the Celtic League called for law changes which would make it impossible for the arms dealers, who trade on the death and misery of hundreds of thousands of people, to operate here. The government responded with the Islands FSC announcing that loopholes would be closed (5). The loopholes however appear to still exist.

Have our calls and those of others (6) gone unheeded with more people dead? Why has no one been prosecuted for assisting in one of the worst genocides in the last decade (indeed century) the massacre of one million Tutsis. We should recognise also that, although the deathsof the European tourists last year were well publicised, the militias armed by these companies are still spreading a rain of murder, rape and destruction across the Central African region with weapons supplied at the time with the help of companies operating from the Isle of Man and other offshore centres.

The Mitterand connection in just the latest in a serious of allegations some proven about links between tax havens and the International arms trade it is past time an extensive International investigation was mounted to root out the merchants of death once and for all

The Radio Station: The Commentator and the Tax Haven Critic

A complaint has been made to Manx Police following, apparently off the cuff, remarks made by a Manx Radio talk show presenter.

Manx Radio’s, Stuart Peters, (who is compere of the stations Talking Heads programme) referring to outspoken UK based tax haven critic, Richard Murphy, said:

“Richard Murphy who is constantly having pops at the Isle of Man and the tax regime here to the point where we are all really rather bored of it to the point where we wish there was a wet ops department in the government that could go and take him out.”

Murphy, responding on his blog, said he took the reference to `wet-ops department’ to mean a KGB assassination unit and was unimpressed (see blog link):

Despite an apology on air Murphy decided to take the issue further and confirmed on a later blog the matter had been referred to Manx police (see blog link):

The resulting furore has whipped up a storm of condemnation (of Murphy) on one Isle of Man internet forum whilst on another he has received support.

It remains to be seen how Manx police deal with the matter and already pundits are sceptical. Manx police seem to have a bewildering concept of priority. Some years ago they conducted a full investigation following an alleged altercation (behind closed doors) in an employment forum. More recently they deployed the
whole force to track down those daubing nationalist slogans in `washable emulsion’ paint. It remains to be seen how seriously they take this alleged `threat’.

Murphy’s Tax Research UK is undoubtedly an annoyance to the Manx government and despite some of the disparaging comments of his internet forum detractors he does have media reach. He has appeared on UK TV and Radio news programmes frequently.

One internet pundit summing the `amusing little spat’ up was sympathetic to Murphy saying:

“Should Richard Murphy just have ignored Peters nonsense? Initially I thought so but Peters and co (IOM Comic Papers) do a lot of kicking of innocent people, unable to fight back. Low paid government workers are particular targets of these worthless bullies, it’s about time somebody held one of them to account. My only regret is that the Manx Police are involved, and not a UK force who, I suspect, would have been a lot less likely to brush it under carpet.”

Is it much ado about nothing – we will see!

Mannin:Role Of Governor Not Compatible With Democracy

MANNIN: ROLE OF GOVERNOR NOT COMPATABLE WITH DEMOCRACY

The concept of the continuing appointment by the United Kingdom* of `Governors’ to oversee Crown dependencies and British overseas territories has been attacked by the Celtic League following the recent appointment of a retired British diplomat as Lieutenant Governor of the Isle of Man.

The Director of Information speaking to BBC TV News said that the Isle of Man should aspire to become a true democracy. Of the title Governor he said:

“Governor in this day and age? It is a ghastly title and it sends the wrong signal about what sort of community we are.”

In a section of the interview not broadcast the DOI said that Tynwald had in recent years itself questioned the wisdom of continuing to maintain the Office of Governor but had failed to pluck up the courage make the change.

Governor An Anachronistic Colonial Vestige

The departure of the Isle of Man’s Lt Governor prompted Manx Radio to depart from its usual `West Brit’ sycophantic coverage and elicit an alternative view.

The Chairman of Mec Vannin, Mark Kermode, and the Celtic League DOI were approached to express a (predictable) view on the role or need for a Lt Governor.

The interview clips were used as part of the intro to the `Talking Heads’ discussion series of programmes and generally the comments both for and against were quite reasoned. There seemed to be only one rabidly anti-nationalist who texted in the hackneyed we will be `back to spuds and herring’ argument and also a curious intervention (also by text) from someone who equated having a Lt Governor to ensuring the Defence of the Isle of Man (they are obviously to young to remember how well the United Kingdom defended the Channel Islands in World War 2!).

An (admittedly) unscientific assessment of the overall comment seemed to indicate a majority questioned the value of the Lt Governors role.

Mannin: Slow Freeze On Libyan Assests

MANN: SLOW FREEZE ON LIBYAN ASSETS

The Manx government has reacted angrily to suggestions it was slow to implement an asset freeze on Libyan leader Colonel Gaddafi and his associates.

Responding to questions from Member of the House of Keys MHK, David Cannan, the Isle of Man Chief Minister, Tony Brown MHK, said a freeze on Libyan assets had been implemented on March 25th 2011 and seemed to be upset that this timeframe (almost four weeks after other governments had implemented such actions) was dilatory.

The Chief Minister said he was appalled at the questioning and implied members were attempting to discredit the Island.

However, should it become apparent that any Libyan sourced funds are held on the Island and could (or have been) moved during the period of inaction by the Manx government it will be extremely embarrassing.

It is not clear if any Libyan funds are held in (or have passed through) Mann. However the Island does have strong links with Arab states and the Gulf States in particular have been an area of several Manx government trade initiatives.

In the past few weeks the Celtic League has criticised tax agreements signed with Bahrain by the Manx government (see link).
